This website is owned and operated by Eco-Box it, LLC®, a registered company in the State of Maryland, United States of America.  By accessing our website, you and all person(s) and/or entity(s) with you, are deemed to have read, and agreed to adhere to the following terms and conditions; also referred to as provisions:

All activity involving or resulting from the use of the Eco-Box it, LLC® website is governed by the terms and conditions; including but not limited to all rentals, purchases, transactions, and communications. Terms and conditions may change at any time without prior notice.  You, the user, agree to accept the responsibility of understanding the terms and conditions at all times including modifications to the terms and conditions after initial use.  The use of the website by any person or entity, domestic or foreign, is governed by the laws of the State of Maryland and the United States federal courts were applicable.  

The User Agreement is entered into between Eco-Box it, LLC®, hereafter referred to as either Eco-Box it, LLC®, “Eco-Box it”, “The Company”, “Owner”, “We”, “Us”, “Our”, or “Ourselves” and You, hereafter referred to as either “You”, “Your”, “User’, “Customer”, or “Client”.  By entering into the User Agreement, you acknowledge and accept (1) all the terms and conditions set forth below and (2) that no other communications or interactions between you and Eco-Box it, LLC® will result in a new condition, guarantee, warranty or provision.

Customer Responsibilities:

  1. You agree to provide Eco-Box it, LLC® with accurate and relevant information in the use of the website and agree to notify us if any of the information provided changes
  2. You agree to access and use the website for its intended use and not for any unlawful activities
  3. Access to our website via automated, unlawful, unconventional or malicious means is strictly prohibited.  This includes network or server intrusions that may or may not disrupt the functionality or business operations of Eco-Box it, LLC®
  4. You acknowledge that you are legally entitled to procure products and services from Eco-Box it, LLC® on your behalf or on the behalf of another person(s), or entity(s) and are not misrepresenting yourself, other person(s), or an entity(s)
  5. You acknowledge and agree that you will only use the products and services of Eco-Box it, LLC® for your use and not to sub-lease, distribute, or sell to any other person(s) or entity(s)
  6. You acknowledge and agree that you will never represent the products and services of Eco-Box it, LLC® without written authorization

Products/Services:

  1. The products and services offered by Eco-Box it, LLC® are considered “as-is” and “as-available”
  2. Products and services will be delivered to and picked up from the Greater Baltimore-Washington Metropolitan area based on zip codes. Click the “Check Your Zip Here! Button located on the landing page to see if we service your area.  We are under no obligation to deliver our products and services to geographical areas outside of our current available zip codes
  3. We reserve the right to limit quantities of products that you rent and/or purchase
  4. We reserve the right to cancel any or all order(s) at our discretion
  5. Our products and/or service may or may not meet your needs or expectations
  6. Interruptions or defects of any kind will be remedied at the soonest possible time

Payment:

  1. We accept major credit cards and debit cards from Visa, MasterCard, American Express, JCB, Discover and Diners Club. We also accept gift and prepaid cards from the same companies listed above. Eco-Box it, LLC® takes your security seriously so all transactions are processed through a secured checkout process
  2. Payment is due in full at the time of the secured checkout in the order process.  Upon checking the box accepting the terms and conditions and clicking process payment, your payment will be processed.  A confirmation page will confirm your order details followed by an email with an attached invoice receipt

Rates and Charges:

You acknowledge and consent to the following additional charges for the products and/or services including but not limited to the following:

  1. Extension of rental package term: All time extensions will be calculated and charged at the per diem rate of the selected bedroom package
  2. Extension of rental supplies: All time extensions will be calculated and charged at the per diem rate of the selected supply
  3. Products that are broken, lost, or damaged: see replacement value in Rental Agreement
  4. Products (boxes, dollies, blankets and any other items we rent) that are contaminated or excessively dirty and need extra cleaning $3 per item.  This includes but is not limited to the following: spillage of any type of liquids, foods, odors, critters/bugs, paint, stains, markers, use of sticky and/or adhesive labels or tapes other than those provided by Eco-Box it – blue painters tape is acceptable. The Renter can pay in cash or with a check cut to “Eco-Box it” LLC on the pick up date or an invoice will be sent to the Renter with the additional charges
  5. Failure to be present at the scheduled date and time of delivery and/or pick up will be charged $80
  6. Boxes not ready for pick up at the scheduled date and time will be assessed $80 charge
  7. Schedule change (request for an extension of the rental period or request for an earlier pick up) of less than 96 hours will incur a $50 charge.  The Renter can pay in cash or with a check cut to “Eco-Box it” LLC on the delivery or on the pick up date
  8. If you cancel with less than 144 hours / 6 days of the original delivery date and time a 25% fee of the original order amount will apply.  Please remember we had to reserve and set aside boxes on your behalf that could have been available in inventory for another customer
  9. Staircases/steps: free ground floor, curbside and elevator delivery and pick up is offered to your residence or place of business. Stairs will be charged at $0.02 per stair per box. For example, if you may have ordered the Studio/1BR package which includes 25 boxes and may have a total of 10 stairs, you will be charged a total of $5.00; for the same number of stairs (10) for the 2 BR package which includes 35 boxes the charge will be $7.00.  Charge includes both delivery and pick up
  10. Boxes kept longer than 6 weeks without prior authorization from Eco-Box it will be charged replacement valued
  11. It is the Renter’s responsibility to remove the labels from the boxes. All boxes on the pick up date should not have any type of labels. If there are labels left on the boxes an additional charge of $0.50 per box will occur. The Renter is responsible for the payment of this amount in cash or with a check cut to “Eco-Box it, LLC” to the driver on the pick up date. If on the pick up date the driver doesn’t see any left behind labels, an invoice will be sent to the Renter with the additional charges.

You authorize Eco-Box it, LLC® to charge the amount(s) specified per the rates and charge provisions listed in the agreement.  Alternative payment options may be arranged with the approval of Eco-Box it, LLC® – including but not limited to the use of PayPal.  Prices do not include applicable state sales tax.

Cancellation Policy:

  1.  If you cancel within a full 144 hours / 6 days of the original delivery date and time there will be no fee and a full refund to your account will occur within 14 business days
  2. If you cancel with less than 144 hours / 6 days of the original delivery date and time a 25% fee of the original order amount will apply.  Please remember we had to reserve and set aside boxes on your behalf that could have been available in inventory for another customer
  3. We reserve the right to cancel any or all order(s) at our discretion

Technology/Email:

  1. Eco-Box it, LLC® is not responsible for any technical failures or loss of information related to the use of independent 3rd-party providers equipment or services, whether paid or free service provided by a 3rd-party
  2. Eco-Box it, LLC® assumes no liability for failed or delayed deliveries or pick ups based on technical issues or failures of a 3rd-party

Website:

  1. We may update or change the website information at any time without notice including pricing and product availability
  2. All pricing is subject to review and confirmation.  This includes, at our discretion, any and all changes needed for product pricing and availability
  3. If discrepancies or errors are identified on the website, we will take necessary corrective actions to resolve and inform any clients affected
  4. Provisions for links to and from our website listed below

Links to and from this Website:

  1. Links to other independent 3rd-party websites from www.ecoboxit.com may be offered to our website users.  These are independent 3rd-party websites and Eco-Box it, LLC® assumes no liability for these websites and any communications or content within the 3rd-party websites.  Eco-Box it, LLC® also assumes no liability for any and all damages resulting from links to 3rd-party websites
  2. Eco-Box it, LLC® may provide open source communication access to independent 3rd-party providers on social media, forums, blogs, rating sites, community driven and business networking sites, etc.  We encourage the responsible use of these various 3rd-party provider networks.  The honor code is in force to those who wish to post remarks about the products and services offered by Eco-Box it, LLC®.  You agree to post constructive and informative remarks and nothing that would be considered harassment, inappropriate or illegal.  We reserve the right to remove any content we judge inappropriate or objectionable.  Abusive, illegal, fraudulent, objectionable, suggestive and similar content will be removed immediately and reported, if necessary, to the proper legal authorities  
  3. Eco-Box it, LLC® assumes no responsibility for failure to remove inappropriate material from independent 3rd-party open source networks in a timely manner but will take all necessary actions to do so
  4. Person(s) or entity(s) that post content to our website or links to the 3rd-party websites that we deem objectionable and inappropriate provide consent to have all objectionable and inappropriate content removed by Eco-Box it, LLC® or a 3rd-party and waive any and all claims against the company for the content removal
  5. Person(s) or entity(s) may not create a link to www.ecoboxit.com without written authorization from Eco-Box it, LLC®

Rental Agreement:

  1. We welcome and encourage you to view our Rental Agreement, which is part of our User Agreement, at https://www.ecoboxit.com/rental-agreement

Privacy:

  1. Eco-Box it, LLC® is committed to protecting your privacy.  It’s simple – we will not and never will offer your information to anyone; that includes selling, renting, or sharing your information to any independent 3rd-party that intends to solicit you.  We welcome and encourage you to view our Privacy Policy, which is part of our User Agreement, at https://www.ecoboxit.com/privacy-policy/

Intellectual Property Rights:

  1. Eco-Box it, LLC® retains ownership and all legal rights to its intellectual property, whether registered or unregistered, including but not limited to our website www.ecoboxit.com, all title, content, logos, banners, images, trademarks, copyrights, code, software development design, flow, function as well as patents and other property rights except those which are used by permission, or licensed or offered free by independent 3rd-party providers
  2. Eco-Box it, LLC® prohibits the unauthorized use of its intellectual property without prior written consent.  This includes but not limited to copying, reproductions, duplicating, selling or any activity that impacts our intellectual property
  3. Any unauthorized activity of a person(s) or entity(s) that impacts the results, imagine, goodwill, and brand of Eco-Box it, LLC® may face criminal and/or civil liability proceedings
  4. All content, posts or communications that you post to our website and/or through 3rd-party open source communications become the sole property of Eco-Box it, LLC® royalty-free and can be used at our discretion, including any reproductions, edits, enhancements, modifications and so on indefinitely.  This excludes all content provided by you through the order and checkout process

Bad Weather/Force Majeure:

  1. We live in an area that unfortunately gets impacted by bad weather.  Because of the unpredictable nature of such events we can only guarantee that we will do our best to deliver or pick up your order on time. If we cannot do it safely, we will coordinate with you to find a mutually acceptable solution and reschedule accordingly.  We thank you in advance for your consideration should such an event occur during your scheduled delivery or pick up
  2. “Force Majeure”, the unforeseeable circumstances that prevent the fulfillment of a contract.   Because of the unpredictable nature of such events we can only guarantee that we will do our best to deliver or pick up your order on time. If we cannot do it safely, we will coordinate with you to find a mutually acceptable solution and reschedule accordingly.  We thank you in advance for your consideration should such an event occur during your scheduled delivery or pick up

Limitation of Liability:

  1. You agree that any claim against us will be limited to the amount that you paid for the products and services of Eco-Box it, LLC®. Please refer to the Indemnity section below

Indemnity:

  1. You agree to indemnify and hold harmless Eco-Box it, LLC®, their directors, officers, managers, partners, employees, as well as any licensors or affiliates, from and against all losses, expenses, damages, costs and reasonable attorneys fees resulting from any breach of the User Agreement
  2. You agree to indemnify and hold harmless Eco-Box it, LLC®, their directors, officers, managers, partners, employees, as well as any licensors or affiliates, from and against all losses, expenses, damages, costs and reasonable attorneys fees resulting from the use of our website and access to 3rd-party links and communications
  3. You agree to indemnify and hold harmless Eco-Box it, LLC®, their directors, officers, managers, partners, employees, as well as any licensors or affiliates, from content posted by person(s) or entity(s) on our website
  4. You agree to indemnify and hold harmless Eco-Box it, LLC®, their directors, officers, managers, partners, employees, as well as any licensors or affiliates, from and against all losses, expenses, damages, costs and reasonable attorneys fees resulting from an incomplete, failed, or delayed obligation to you
  5. You agree to indemnify and hold harmless Eco-Box it, LLC®, their directors, officers, managers, partners, employees, as well as any licensors or affiliates, from and against all losses, expenses, damages, costs and reasonable attorneys fees resulting from the use of our website, products or services
  6. Any provision(s) of this User Agreement deemed invalid or unenforceable by a court or other legal entity shall not impact or terminate the remaining provisions of the User Agreement.  If the intention of the provision(s) in question is clear yet required an amendment to state or fulfill accurately the provision, then any such modification would take effect immediately upon completion if so warranted by the judicial body; otherwise the provision(s) would be deleted and all remaining provisions would remain in full force and effect
